BY ENROLLING IN THE ENHANCED BREAST CANCER DETECTION (EBCD) PROGRAM POWERED BY DEEPHEALTH YOU AGREE TO THE FOLLOWING:

This provides the website MYEBCDMAMMO.COM (the "Site"), the Enhanced Breast Cancer Detection (EBCD) Service Powered by DeepHealth (collectively, the "Service"), and the Patient Portal (the “Portal”) are subject to your compliance with the terms and conditions set forth in this agreement (the "Agreement").

This Agreement governs the relationship between you, the patient, with respect to your use of the Enhanced Breast Cancer Detection Site, Service, and Portal.

It is important that you read carefully and understand the terms and conditions of this Agreement and the privacy policy and notice (RadNet Website Privacy Statement) regarding the collection of information about you. Please note that by using the Site, Service, and the Portal, you are deemed to have accepted the terms and conditions of this Agreement and the Privacy Policy, and to receive notices of amendments and modifications to this Agreement. We reserve the right at any time to: change the terms and conditions of this Agreement; change the Site, Service, or Portal, including eliminating or discontinuing any feature of the Service, Portal, or any content on the Site.

1. In order to use the Services, the Site, and the Portal, available for the Enhanced Breast Cancer Detection service, you are required to become a registered user with an account. It is important that you read carefully and understand the terms and conditions. YOU ARE ENTIRELY RESPONSIBLE FOR MAINTAINING THE CONFIDENTIALITY OF YOUR USERNAME AND PASSWORD AND FOR ANY AND ALL ACTIVITIES THAT ARE CONDUCTED THROUGH THE PATIENT PORTAL USING YOUR USERNAME AND PASSWORD.

2. Code of Conduct. While using the Site, Service, and Portal, you agree not to:

  • Restrict or inhibit any other visitor or member from using the Site or Portal, including, without limitation, by means of “hacking” or defacing any portion of the Site
  • Use the Site, Portal, or Service, for any unlawful purpose
  • Express or imply that any statements you make are endorsed by us, without our prior written consent
  • Transmit:
    • any content or information that is unlawful, fraudulent, threatening, abusive, libelous, defamatory, obscene or otherwise objectionable, or infringes our or any third party’s intellectual property or other rights
    • any material, non-public information about companies without the authorization to do so
    • any trade secret of any third party, or
    • any advertisements, solicitations, chain letters, pyramid schemes, investment opportunities or other unsolicited commercial communication (except as otherwise expressly permitted by us)
  • Engage in spamming or flooding
  • Transmit any software or other materials that contain any viruses, worms, trojan horses, defects, date bombs, time bombs or other items of a destructive nature
  • Modify, adapt, sub-license, translate, sell, reverse engineer, decompile or disassemble any portion of the Site, Service, Portal, or Report.
  • Remove any copyright, trademark or other proprietary rights notices contained in the Site, Service, Portal, or Report.
  • "Frame" or "mirror" any part of the Site without our prior written authorization
  • Use any robot, spider, site search/retrieval application or other manual or automatic device or process to retrieve, index, "data mine" or in any way reproduce or circumvent the navigational structure or presentation of the Site or its contents, or
  • Harvest or collect information about Site visitors or members without their express consent.

3. Payment for the Service. I acknowledge that the Services are not covered by insurance and agree that I am paying out of pocket for the Services. I agree that I will not bill or subsequently attempt to collect reimbursement or payment from any insurance company or third-party payor for the Services.  I understand that as a result, the Services that I receive and the payments that I make will not be applied to any insurance deductible, co-pays or any out-of-pocket maximums. I understand that Provider will not bill any insurance company for these Services provided to or for me. I have been able to ask any questions and received answers to any questions that I have regarding the payment terms to which I am agreeing.

Any changes we make will be effective immediately upon notice, which we will provide by means including, without limitation, posting on the Site. Your continued use of the Site, Service, Portal, or Report, after such changes will be deemed acceptance of them.

Your use of the Site, Service, or Portal, and any dispute related to use of information provided to us, is subject to the then-current version of the Terms of Use agreement. IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT USE THIS SITE OR THE SERVICE, SITE, OR PORTAL.
